Representing and Defending Social and Economic Committees (CSEs)

The Social and Economic Committee (CSE) is the single employee representative body, composed of the employer and an elected employee delegation. The number of members of this delegation is determined by the size of the workforce.

A Body Established Under the Macron Labour Law Reforms

Established under the Macron labour law reforms, the Social and Economic Committee (CSE) replaced several former employee representative bodies:

  • The Works Council (CE);
  • Employee Representatives (DP);
  • The Health, Safety and Working Conditions Committee (CHSCT).

Understanding Your Rights and Obligations

Knowledge of the key applicable legal provisions is essential for employee representatives.

In certain circumstances, elected members of the Social and Economic Committee (CSE) may benefit from the assistance of an employment lawyer to ensure that their actions comply with the law and to protect their interests.

Establishment of the CSE and Workplace Elections

Our law firm can assist you at every stage of the Social and Economic Committee’s (CSE) activities:

  • Advising you on the procedures for establishing the CSE;
  • Assisting you throughout the electoral process;
  • Representing you in the event of a challenge to the election results;
  • Providing legal representation in all types of court proceedings.

Acting as Your Specialist Employment Lawyer

Our law firm can act as an independent legal expert.

In this specific capacity, the lawyer is jointly appointed by the company’s management and employee representatives to provide specialist legal expertise on a particular matter.

Internal Investigations: Harassment and Psychosocial Risks

This type of intervention may notably involve internal investigations provided for and governed by employment law, particularly in cases of harassment or psychosocial risks.

In such circumstances, the independent legal expert is jointly appointed by both parties. In this capacity:

  • The expert cannot act as the company’s regular legal adviser.
  • The expert cannot represent either party in any proceedings arising from the investigation.
  • The expert’s report is not protected by legal professional privilege.
